Agreement

These Terms of Use govern your access to and use of Presence ("the service"). By creating an account or using the service, you agree to these terms. If you are using Presence on behalf of an organization, you confirm you are authorized to bind that organization.

The service

Presence provides attendance and membership tools, including Apple Wallet passes, QR check-in, reminders, visitor passes, and reporting. We may add, change, or remove features over time.

Accounts

You are responsible for your account, for keeping your credentials secure, and for activity under your account. You must provide accurate information and be at least the age of majority in your jurisdiction.

Your data and responsibilities

You own the data you add (members, attendees, check-ins) and grant us the rights needed to provide the service. As the controller of that data, you are responsible for having a lawful basis to collect and use it, and for obtaining any consent required, including consent to send WhatsApp or SMS reminders.

You agree to use the service lawfully and not to upload unlawful content, infringe others’ rights, or attempt to disrupt or gain unauthorized access to the service.

Plans, billing, and credits

Paid plans are billed in advance through our payment provider (Paystack). Upgrades and downgrades take effect as described in the app and prorate where applicable.

WhatsApp and SMS messages are sent using prepaid message credits. Credits are drawn down per message and are non-refundable except where required by law. Free channels (web/in-app reminders) are included.

Messaging compliance

You are responsible for complying with the rules of the messaging channels you enable (including WhatsApp and SMS provider policies and applicable anti-spam laws), and for honoring opt-out requests.

Intellectual property

Presence, its software, and its branding are owned by us. These terms do not grant you any rights to our intellectual property except the limited right to use the service.

Third-party services

The service relies on third parties (such as Google Firebase, Paystack, Apple, and messaging providers). Their services are governed by their own terms, and we are not responsible for their acts or omissions.

Disclaimers

The service is provided "as is" without warranties of any kind. We do not guarantee that it will be uninterrupted, error-free, or that every scan or reminder will be delivered.

Limitation of liability

To the maximum extent permitted by law, Presence will not be liable for indirect, incidental, or consequential damages, and our total liability is limited to the amount you paid us in the three months before the claim.

Termination

You may stop using the service at any time. We may suspend or terminate access for breach of these terms or non-payment. On termination, your right to use the service ends; you may request an export of your data within a reasonable period.

Changes

We may update these terms from time to time. Material changes will be reflected by the date below; continued use means you accept the updated terms.

Governing law

These terms are governed by the laws of Ghana, unless otherwise required by applicable law.
